About 95 percent of registered eligible patients are now enrolled in the Stryker modular hip settlement program. Payments are expected to begin next month, with the majority of payments being made by fall 2015.
The Master Settlement Agreement was announced in November 2014. Established to compensate patients who underwent revision surgery to replace their Stryker Rejuvenate Modular-Neck hip stem and/or ABG II Modular-Neck hip stem, the program ensures that eligible patients will receive a share of $1 billion, according to Reuters.
The Claims Processor will soon reach out to claimants and their attorneys concerning compensation payments. How much each claimant receives will depend on a variety of factors and circumstances specific to each claim. Most claimants can expect to receive either $300,000 or $600,000, depending on the number of implants they had and on how many revisions the patient undergone. The older the patient is, the less the patient should expect to receive. Patients who suffered complications during revision surgery may receive a higher amount. This amount also applies to future surgeries and treatments, Florida Newswire reported.
In addition to the announcement letter, Stryker also sent a letter that same day to judges in New Jersey, Minnesota and Florida where Stryker Rejuvenate and ABG II MoM modular hip implants litigations, were proceeding, to inform them of the 95 percent enrollment number, according to Florida Newswire.
Florida Newswire reported that Retired Magistrate Judge Diane Welsh, formerly of the U.S. District Court for the Eastern District of Pennsylvania, served as the court appointed mediator. The parties were encouraged to settle by Bergen County, New Jersey, Superior Court Judge Brian R. Martinotti. Martinotti also initiated the mediation program.
Patients allege the Stryker ABG II and Rejuvenate Modular Hip System caused them injuries including pain, loosening of the joint, hip dislocation, difficulty walking and cysts around the joint. Stryker recalled the devices in June 2012.
